২: সংজ্ঞা
এই চুক্তিতে—

গ্রাহক / ব্যবহারকারী বলতে যে ব্যক্তি বা প্রতিষ্ঠান আমাদের পরিষেবা ব্যবহার করে তাকে বোঝায়।
ডিভাইস বলতে গাড়িতে ইনস্টল করা GPS ট্র্যাকিং ডিভাইস বোঝায়।
পরিষেবা বলতে MOTOTRACK GPS প্রদত্ত ট্র্যাকিং ও ফ্লিট ম্যানেজমেন্ট পরিষেবা বোঝায়।
৩: শর্তাবলী গ্রহণ
আপনি যদি আমাদের ওয়েবসাইট ব্যবহার করেন, অ্যাকাউন্ট তৈরি করেন, বা GPS ডিভাইস ইনস্টল করে পরিষেবা ব্যবহার করেন, তাহলে ধরে নেওয়া হবে যে আপনি এই শর্তাবলী পড়েছেন এবং সম্মত হয়েছেন।
ধারা ৪: ব্যবহারযোগ্যতা
পরিষেবা ব্যবহার করার জন্য আপনাকে—
• কমপক্ষে ১৮ বছর বয়সী হতে হবে
• গাড়ি ব্যবহারের বৈধ অনুমতি থাকতে হবে
• সঠিক তথ্য প্রদান করতে হবে
ভুল তথ্য প্রদান করলে কোম্পানি পরিষেবা বাতিল করতে পারে।
৫: অ্যাকাউন্ট নিবন্ধন
ওয়েবসাইট বা অ্যাপের কিছু ফিচার ব্যবহার করার জন্য অ্যাকাউন্ট তৈরি করতে হবে।
ব্যবহারকারীকে—
• নিজের লগইন তথ্য গোপন রাখতে হবে
• সঠিক তথ্য প্রদান করতে হবে
• অ্যাকাউন্টের সকল কার্যকলাপের দায়িত্ব নিতে হবে

পরিষেবাগুলোর মধ্যে থাকতে পারে:

৭: পরিষেবার প্রাপ্যতা
পরিষেবাগুলো GPS স্যাটেলাইট, মোবাইল নেটওয়ার্ক এবং ইন্টারনেটের উপর নির্ভরশীল।
নিম্নোক্ত কারণে পরিষেবা ব্যাহত হতে পারে—
• নেটওয়ার্ক সমস্যা
• দুর্বল GPS সিগন্যাল
• আবহাওয়া
• সার্ভার আপডেট
• প্রযুক্তিগত ত্রুটি
MOTOTRACK GPS সর্বোচ্চ ৯৯% সার্ভার আপটাইম বজায় রাখার চেষ্টা করে।
৮: সাবস্ক্রিপশন ও পেমেন্ট
গ্রাহককে ডিভাইস মূল্য এবং বার্ষিক সাবস্ক্রিপশন ফি প্রদান করতে হবে।
নির্ধারিত সময়ের মধ্যে পেমেন্ট না করলে—
• পরিষেবা সাময়িকভাবে বন্ধ হতে পারে
• অ্যাকাউন্ট স্থগিত হতে পারে
• পুনরায় চালু করতে অতিরিক্ত ফি প্রযোজ্য হতে পারে
৯: ব্যবহারকারীর দায়িত্ব
ব্যবহারকারীকে—
• আইনসম্মতভাবে পরিষেবা ব্যবহার করতে হবে
• ডিভাইস সঠিকভাবে ইনস্টল করতে হবে
• গাড়ির বিদ্যুৎ সংযোগ ঠিক রাখতে হবে
ডিভাইস ব্যবহারের সম্পূর্ণ দায়িত্ব ব্যবহারকারীর।
১০: নিষিদ্ধ কার্যকলাপ
নিম্নলিখিত কাজগুলো নিষিদ্ধ—
• অবৈধ ট্র্যাকিং
• অনুমতি ছাড়া কাউকে ট্র্যাক করা
• সিস্টেম হ্যাক করার চেষ্টা
• সফটওয়্যার রিভার্স ইঞ্জিনিয়ারিং
• ভাইরাস বা ক্ষতিকর কোড আপলোড
এ ধরনের কার্যকলাপের ক্ষেত্রে পরিষেবা বন্ধ করা হতে পারে।
১১: মেধাস্বত্ব
ওয়েবসাইটের সকল কন্টেন্ট যেমন—
• সফটওয়্যার
• লোগো
• টেক্সট
• ডিজাইন
• ছবি
MOTOTRACK GPS এর মেধাস্বত্বের অন্তর্ভুক্ত।
অনুমতি ছাড়া এগুলো ব্যবহার করা যাবে না।
১২: গোপনীয়তা ও ডেটা সংগ্রহ

এই তথ্য পরিষেবা উন্নত করা ও নিরাপত্তা নিশ্চিত করার জন্য ব্যবহার করা হয়।
১৩: তৃতীয় পক্ষের পরিষেবা
আমাদের পরিষেবা নিম্নলিখিত তৃতীয় পক্ষের উপর নির্ভর করতে পারে—
• মোবাইল নেটওয়ার্ক অপারেটর
• ক্লাউড সার্ভার প্রদানকারী
• GPS স্যাটেলাইট সিস্টেম
এই পরিষেবাগুলোর সমস্যার জন্য MOTOTRACK GPS দায়ী নয়।
১৪: হারানো বা চুরি হওয়া গাড়ি
MOTOTRACK GPS গাড়ির লোকেশন তথ্য প্রদান করতে পারে।
তবে কোম্পানি গাড়ি উদ্ধার নিশ্চিত করতে পারে না।
চুরি হলে গ্রাহককে প্রথমে আইনশৃঙ্খলা বাহিনীকে জানাতে হবে।
১৫: দায়বদ্ধতার সীমাবদ্ধতা
MOTOTRACK GPS নিম্নোক্ত বিষয়ে দায়ী থাকবে না—
• গাড়ি চুরি
• সম্পদের ক্ষতি
• ব্যক্তিগত আঘাত
• ডেটা হারানো
• GPS লোকেশন ত্রুটি
• নেটওয়ার্ক সমস্যা
পরিষেবাটি “যেমন আছে” (As-Is) ভিত্তিতে প্রদান করা হয়।
১৬: ক্ষতিপূরণ
ব্যবহারকারী সম্মত হন যে পরিষেবার অপব্যবহার বা আইন ভঙ্গের কারণে যদি কোনো ক্ষতি বা দাবি সৃষ্টি হয়, তাহলে MOTOTRACK GPS এর বিরুদ্ধে কোনো দাবি করবেন না।
১৭: পরিষেবা বাতিল
নিম্নলিখিত ক্ষেত্রে MOTOTRACK GPS পরিষেবা বাতিল করতে পারে—
• শর্তাবলী লঙ্ঘন
• পেমেন্ট বকেয়া
• অবৈধ ব্যবহার
গুরুতর ক্ষেত্রে পূর্ব নোটিশ ছাড়াই পরিষেবা বন্ধ করা হতে পারে।
১৮: আইনগত প্রযোজ্যতা
এই শর্তাবলী গণপ্রজাতন্ত্রী বাংলাদেশের আইন অনুযায়ী পরিচালিত হবে।
১৯: শর্তাবলী পরিবর্তন
MOTOTRACK GPS যে কোনো সময় এই শর্তাবলী পরিবর্তন করতে পারে।
পরিবর্তিত শর্তাবলী ওয়েবসাইটে প্রকাশ করা হবে।
